The authority granted the right to impose a fine not exceeding two million riyals in the event of a violator; Not to implement any decision or directive issued by it, or when providing false statements or misleading information.
The regulations oblige the Authority, when estimating the fine, to take into consideration the proportionality between it and the violation, provided that the mitigating and aggravating circumstances, and the seriousness of the violation are taken into account, in that the violation results in harm to lives, property, people’s health, the environment, or public order, and the recurrence of the violation. and the number of violations.
The maximum penalty for any violation shall be the imposition of a financial fine up to the cost of the license (×10), not exceeding 20 million riyals for violations whose total percentages of criteria for determining severity did not exceed 100%, and the Committee may double the amount of the financial fine when the violation is repeated, and not exceeding 20 million riyals, while the penalty for practicing any activity without obtaining a license from the authority is to impose a specific fine of 10 times the cost of the license for the same practice, and not exceeding 20 million riyals.
Financial sanctions mechanism
The regulations specify the imposition of fines in the event that the violator commits any act contrary to the Authority’s regulations or licensing controls and conditions. The violator is referred to a committee to consider violations of the provisions of the system. To consider the violation and assess the appropriate financial fine; According to the seriousness and seriousness of the violation committed.
The mechanism for determining financial penalties for violations included; According to several criteria, including the extent of the radiological effect of the violation on the environment, the extent of the impact of the violation on the general public, the level of risk expected from the nuclear facility or radiological practice, according to the classification of nuclear facilities and radiation practices and activities set by the Authority, whether the violation occurred or when it was discovered before it occurred, and the commission of any It is one of the crimes stipulated in Article 24 of the system, and those against whom a decision has been issued by the committee may complain before the Board of Grievances in accordance with its system.
The regulations indicated that the application for the establishment of nuclear facilities requires the approval of the Council of Ministers before examining the application for licenses related to them, and the application is submitted to the Authority, including information related to the control work that shows the type of nuclear facility to be requested for a license, and the extent to which it fulfills the international obligations of the Kingdom, and if the nuclear facility is a station For nuclear energy, the capacity and number of reactors must be mentioned, in addition to providing evidence that the capabilities and financial resources are available, in order to ensure the fulfillment of the requirements of safety, security and nuclear guarantees.
Means of reporting violations
The regulations stressed that the Authority shall submit the request of the nuclear facility to the Council of Ministers, including its views according to its competence, and after obtaining the approval of the Council of Ministers, the Authority shall consider the application for licenses for nuclear facilities, or their renewal, modification, suspension, cancellation or approval of their sites, then the Authority shall submit the license application to The Board takes its decision on the application, after which the Board issues its decisions after reviewing the Authority’s recommendations and verifying their completeness.
The regulation indicated that the authority has the authority to supervise the process of recovering orphan sources, and any other radioactive source from the moment it was detected until its disposal, and to recommend activating the national plan for responding to nuclear and radiological emergencies if necessary, while the King Abdullah City for Atomic and Renewable Energy is responsible for notifying the authority when Receiving any communication related to radioactive sources outside the regulatory control, receiving radioactive sources, and any other radioactive source that is seized based on the authority’s approval, ensuring the safety and security of these sources, and assuming the responsibilities of recovering orphan radioactive sources and their costs, and managing them.
The regulation indicated the means of reporting violations; Including the specialized employees in the secretariat of the committee, the text messages sent to the documented mobile, the e-mail recorded in the violation journal, the national address, any of the accounts registered in one of the government automated systems, and any other means that the committee deems necessary and by which the notification is verified.
